TRUSTEE FEES & FORM 1099-NEC
 Explicit Student Teaching Module
 Blue Is the Code
1. Core Rule (No Ambiguity)
If a trust pays someone for DOING the job of trustee, that payment is compensation for services. Compensation for
services is never a dividend, never a trust distribution, and never a return of principal. It must be reported as
non-employee compensation.
2. Parties in This Example
Payer: CKS Trust
Payee: Chris Nero (Trustee)
Reason for payment: Fiduciary services (administering and managing the trust).
3. Correct Tax Form
The ONLY correct tax form for trustee fees is Form 1099-NEC. This applies whether the trustee is paid monthly,
quarterly, yearly, or per task.
4. Forms That Are NOT Used
1099-DIV is not used because trustee fees are not profits from ownership.
1099-MISC is not used for services.
Schedule K-1 is not used because trustee fees are not beneficiary distributions.
5. TIN Requirement (W-9)
The trust must collect a Form W-9 from the trustee. If the trustee is paid personally, the SSN is used. If the trustee is
paid through a legitimate entity, that entity’s EIN is used. The TIN must match the tax return that reports the income.

7. How This Appears on Form 1041
Trustee fees are deducted as an administrative expense on Form 1041. This reduces the trust’s taxable income.
Beneficiaries are not taxed on trustee fees.
8. Common Student Errors
Calling trustee fees a distribution.
Using 1099-DIV because money came from a trust.
Using 1099-MISC out of habit.
Failing to collect a W-9.

9. One-Sentence Rule to Memorize
If a trust pays someone for being the trustee, it must issue Form 1099-NEC.
