Integrated Educational Packet: Debt Validation, Lack of Consideration, Conditional Acceptance and §1341 (Frauds & Swindles) Sidebar
Blueprint of Justice – Classroom & Study Use
A. Core Teaching: How the Separation Happens and the Remedy
Modern mortgage and credit transactions create two instruments: (1) the Promissory Note (commercial paper) and (2) the Deed of Trust/Mortgage (property lien). A severability clause authorizes their separation, enabling the Note to be endorsed, sold, or securitized while the lien remains recorded. Enforcement requires unity of standing—the same party must be entitled to enforce the Note and hold the beneficial interest in the lien.
The remedy is not denial but Conditional Acceptance: accept the claim upon proof of standing and value. This keeps the respondent in honor, shifts the burden of proof, and documents nonperformance if verification is not produced.
Legal Anchors (Education)
• FDCPA §1692g(b): Collection must cease after written dispute until verification is provided.
• UCC §3-301: Person entitled to enforce an instrument.
• UCC §3-303(a)(1): Value given for an instrument.
• UCC §9-203(b)(1): Enforceability requires value and attachment.
• UCC §§4-214(a), 4-211: Bank gives value upon withdrawal; value to extent of security interest.
• UCC §1-308: Reservation of rights; Conditional Acceptance.
Remedy Flow (Education)
• 1) Debt Validation (FDCPA) + Conditional Acceptance (UCC).
• 2) Demand proof of value, standing, unity of Note & Deed, and full ledger.
• 3) If mailings continue without verification, issue Notice of Continued Collection.
• 4) Provide final Opportunity to Cure.
• 5) Preserve the record (dishonor/nonverification).
B. Sidebar (One Page): 18 U.S.C. §1341 — Frauds and Swindles (Mail Fraud)
This sidebar is educational. It explains when continued mailings may become evidence relevant to §1341. It does not accuse; it documents conduct for regulators or investigators to assess.
What §1341 Requires (Elements)
• A scheme or artifice to defraud.
• Intent to obtain money or property.
• Use of the U.S. mail or interstate carriers.
• Material misrepresentation or omission.
Why Continued Mailings Matter After Validation
• Knowledge: Proof of delivery shows awareness of the dispute.
• Misrepresentation: Billing implies a valid obligation despite no verification.
• Purpose: Mailings seek to induce payment.
• Pattern: Repeated monthly notices after notice.
• Concealment: Failure to disclose disputed/unverified status.
Teaching Caution (Language to Use)
Do not label conduct as mail fraud in correspondence. Document continued collection and note that such conduct may evidence fraudulent intent under federal law if it persists.
Model Sidebar Language (Educational)
“Your continued mailings after written dispute and failure to validate may evidence a scheme to obtain money by misrepresentation using the mail, as contemplated under 18 U.S.C. §1341. This notice provides an opportunity to cure.”
