UNDERWRITER LIABILITY AND CREDIT-DENIAL DISCLOSURE NOTICE
(Issued under the authority of federal law – Blue Code Edition)
Introductory Declaration:
This Notice is issued under the authority of federal law and is protected under the Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.) and the Equal Credit Opportunity Act (15 U.S.C. § 1691 et seq.). It is presented in good faith for educational, administrative, and compliance-awareness purposes, demonstrating lawful standing and understanding of the obligations imposed on financial institutions, underwriters, and credit decision-makers when using a consumer’s private identifying data and credit file.
Purpose and Authority:
The purpose of this Notice is to establish a clear record of communication between the undersigned and any financial institution, creditor, or underwriter who has accessed, used, or relied upon my Social Security Number and consumer credit report for underwriting, screening, or financial evaluation. Upon doing so, the entity becomes a “user of consumer reports” as defined under 15 U.S.C. § 1681a(f) and assumes full responsibility to comply with federal law, including accuracy, fairness, disclosure, and due process requirements.
Applicable Law:
1. Fair Credit Reporting Act (FCRA) – 15 U.S.C. § 1681 et seq. Establishes duties for users of consumer reports to maintain accuracy, disclose adverse actions, and ensure fairness. Once an institution uses a consumer report, it must provide written notice if it takes any adverse action, as required by § 1681m. 2. Equal Credit Opportunity Act (ECOA) – 15 U.S.C. § 1691 et seq. Prohibits discrimination in credit transactions and requires creditors to issue a written explanation for any adverse decision. Failure to provide such explanation constitutes a violation subject to civil liability under § 1691(a).
Expanded Summary of Underwriter Duties:
When a lender, broker, or underwriter accesses a consumer’s credit file using the Social Security Number or any other personal identifier, it has effectively drawn upon the consumer’s credit energy, value, and identity as underwriting consideration. From that moment, the lender is bound by federal obligations to ensure accuracy, provide written notice of any adverse action, and disclose all criteria used in the decision process. Refusal to extend credit after utilizing such data—without lawful disclosure—constitutes an adverse action under 15 U.S.C. § 1681m. The underwriter’s use of consumer data creates a fiduciary relationship with corresponding duties. Denial without transparency represents not only statutory noncompliance but also a breach of fair-dealing obligations under commercial law. Each time the underwriter uses the SSN, a lawful transaction is initiated wherein the consumer’s credit is accessed; denial thereafter without lawful basis may constitute willful violation under §§ 1681n, 1681o, and 1691(a).
Good-Faith Demand for Disclosure and Compliance:
Accordingly, in good faith and under lawful notice, I respectfully request that any financial institution, lender, or underwriter who has accessed my consumer credit file provide the following: 1. A complete copy of the underwriting record and credit report relied upon. 2. The exact underwriting criteria, algorithmic factors, or scoring model used to determine denial or modification of credit terms. 3. Written identification of all third parties or affiliates that accessed or used my credit information in connection with the decision. 4. Confirmation that no data derived from my credit report was sold, transferred, or used for profit without express authorization. This request is made for the purpose of transparency and lawful compliance. The failure to respond constitutes constructive notice of violation, potential willful noncompliance, and acknowledgment of adverse action contrary to the FCRA and ECOA.
Respectfully submitted under full faith, good conscience, and lawful notice,
