EXHIBIT M – ARIZONA CONSTITUTIONAL RIGHT TO PRIVACY ADDENDUM
(Issued under the authority of Article 2 § 8 of the Arizona Constitution and integrated with federal protections under 15 U.S.C. §§ 1681, 1691 and 5 U.S.C. § 552a – Blue Code Edition)
1. Purpose and Authority
This Addendum asserts the constitutional right to privacy guaranteed under Article 2 § 8 of the Arizona Constitution. It establishes that all individuals within Arizona are entitled to protection of their private affairs against unauthorized intrusion, access, or disclosure by any public or private entity acting under color of law or license.
2. Constitutional Provision
“No person shall be disturbed in his private affairs, or his home invaded, without authority of law.” — Arizona Constitution, Article 2, Section 8 This clause stands as Arizona’s explicit privacy guarantee, providing broader protection than the Fourth Amendment by directly naming the ‘private affairs’ of the individual as constitutionally inviolable.
3. Scope of Protection
Arizona courts interpret ‘private affairs’ to include personal communications, financial records, identifying data, and other sensitive information. Unauthorized access, disclosure, or use of such data by state-regulated institutions, officers, or agents may constitute a direct constitutional violation.
4. Application to Current Matters
Any use of a consumer’s Social Security Number, credit file, trust identifiers, or estate documents by financial institutions or state actors without lawful consent intrudes upon private affairs under Article 2 § 8. Such actions also intersect with the following laws: • A.R.S. § 44-1522 (Unlawful Practices Act) • 15 U.S.C. § 1681 (Fair Credit Reporting Act) • 5 U.S.C. § 552a (Privacy Act of 1974)
5. Notice and Affirmation
This filing serves as notice that any unauthorized access, storage, or transmission of private identifying data is prohibited absent express lawful authority. Parties in receipt are hereby placed on notice of both constitutional and statutory liability.
6. Closing
